State law is the floor. Some Pennsylvania municipalities add a permit, zoning limits or signage rules. Always confirm with your city — these rules change.
01 — Philadelphia
Philadelphia
- A Philadelphia Tobacco Retailer Permit is required to sell any tobacco or vape product — one permit per person, per fixed location (Phila. Code § 9-631).
- Display the permit at the location.
- New permits are capped per Planning District (density limit) and are not issued within 500 feet of a K-12 school. Existing permits that are renewed on time are exempt; a lapsed permit loses the exemption.
- Annual fee reported as $300. Renewals for 2027 open September 15, 2026 and are due by December 31, 2026; a $50 late fee applies after November 1, and renewals are not accepted after December 31. Confirm with the city.
- A third violation at one location within 24 months can lead to a one-year cease-sales order at that location. Confirm with the city.
- You also need a city Commercial Activity License. Confirm with the city.
02 — Pittsburgh
Pittsburgh & Allegheny County
- Pittsburgh's zoning ordinance bars new vape and smoke shops in neighbourhood commercial districts. Confirm the details with the city.
- Allegheny County restricts indoor vaping in the same places smoking is banned. Confirm with the county.
03 — Elsewhere
